to be all like OH YES UNIVERSE OH YES THAT'S RIGHT. "The evidence shows that the movement of marriage away from a gendered institution and toward an institution free from state-mandated gender roles reflects an evolution in the understanding of gender rather than a change in marriage. The evidence did not show any historical purpose for excluding same-sex couples from marriage, as states have never required spouses to have an ability or willingness to procreate in order to marry. FF 21. Rather, the exclusion exists as an artifact of a time when the genders were seen as having distinct roles in society and in marriage. That time has passed."]
So, so happy for this.
So, so happy for this. Next stop, New York?? (hopes hopes hopes)
Great news. I hope it eventually brings the same overturn-of-an-overturn here to Maine.
And then there was that other pro-gay/feminist news, from Anne Rice.
Amen.
". . . a time when the genders were seen as having distinct roles in society and in marriage. That time has passed."
Win.
(If only it were true, though. To clarify, I don't think the time when the genders are SEEN that way by the majority has in fact passed, but I'd like to hurry it out the door.)
"...as states have never required spouses to have an ability or willingness to procreate in order to marry."
YOU HEAR THAT WASHINGTON STATE SUPREME COURT?!
Excellent news indeed - now let's just hope it doesn't get overturned by a higher court...
Hear, hear!
Victory screech! SQUAWP! SQUAWP!!!
I just gained a little more respect for America.
Eff yes!
Read the whole ruling! It really makes me want to give Vaughn R. Walker a big hug. And it gives me hope that it might be ok when this goes before the Supreme Court.
Massive win. I'm very excited for anyone who thinks the gender binary is kind of played out...
You do realize what this means, right? Federal judges are reading Le R's blog. This decision clearly came down in honor of theme week.
If my victory dance didn't look quite so much like I'm having a seizure, I'd be doing it in the streets right now.
"That time has passed."
IT'S OVER, THE LAW SAYS SO.
(Okay, maybe it's not that easy but I loved that quote and wish it was that easy.)
I hope this begins a tidal wave of reform that leads to a new civil rights golden age - one for gender and sexuality. This is a wonderful step forward.
But I also hope we don't lose sight of the differences in genders and that we do have distinct roles to play. There is masculine and feminine energy and they each have a focus that makes them unique and magnificent. In the 70s, we threw out the baby with the bathwater on that one and we're still trying to recover.
[But Andrew Pugno, a lawyer for the defense, said Proposition 8 had nothing to do with discrimination, but rather with the will of California voters who “simply wished to preserve the historic definition of marriage.”
“The other side’s attack upon their good will and motives is lamentable and preposterous,” Mr. Pugno said in a statement.]
Good will? What the F is this ass talking about?
Other than that, I was VERY happy to read this in this morning's paper. It might not mean the war is over, but a key battle has been won. Of course, it didn't have to be a war in the first place if some people were more open-minded.
It's heartening to see the decision, but I'm already dreading the nastiness of the "opposition" as we wend our way toward the Supreme Court.
Sam, I couldn't disagree more. In fact, once I move beyond happiness at this step toward equality for my gay friends, what I love love LOVE about this decision is the bit I quoted, specifically repudiating that idea. I don't believe there is masculine energy and feminine energy: there are people, and each person has his or her own type of energy. Some people's energy conforms more with traditional gender roles, and some doesn't, and all people should be free to go where their energy takes them and find the most satisfying expression of their individual energy.
What Joe said! GENDER TROUBLE IN THE HOUSE
